Santa Claus has been put behind the bars for allegedly pinching the butt of his elf.

The 62-year-old Herbert Jones, who was working as a Santa Claus in the Hanover Mall in Massachusetts, has been arraigned on accounts of indecent assault and battery, for pinching the buttocks of on 18 year old co-worker.

The woman, who was completely taken by this act, went weeping to the police and lodged a complain against him for pinching her from his chair as she walked by.

Jones, however, has refuted all charges claiming that it was the woman who brushed against him and he moved his hand away.

A judge has set him free on the condition that he won't play Santa this season.
