Bollywood actor Salman Khan will have to undergo fresh trial in the 2002 hit-and-run case after session court fired his plea to invoke the charges of culpable homicide not amounting to murder issued by the Bandra metropolitan court. The verdict was passed against khan after examining 17 witnesses.
The actor was previously tried for a lesser offense of “causing death by negligence” under Section 304 A of IPC with maximum two years of imprisonment.
Since culpable homicide cases are triable by sessions court, the Bandra magistrate had transferred the case to the sessions court after Salman appealed against the Metropolitan court's order.
However, now, the actor will have to face a harsher trial pertaining to culpable homicide that could land him 10 years behind the bars.
Contesting the grave charge of culpable homicide not amounting to murder (section 304 part II IPC), against the actor, Salman's counsel Mundargi asked for invoking the order which he argued was "erroneous, bad in law and contrary to evidence on record."
Ashok Mundargi, Salman's counsel said that they would contest the verdict in the High Court.
