The appeal against Arizona’s abortion law has been rejected by Arizona’s appeal court panel on Tuesday. The plea was filed by two civil rights group against Arizona’s abortion law banning abortion on the basis of the child’s sex and race.
According to the panel of the 9th U.S. Circuit Court of Appeals, it is being tough to prosecute Maricopa County branch of the National Association for the Advancement of Colored People (NAACP) and the National Asian Pacific American Women’s Forum.
As per the rules of Arizona’s abortion law, abortion based on the child’s sex and race is the serious offense.
Earlier, the case has been argued by an attorney with the Arizona Attorney General’s Office. The Christian legal group, Alliance Defending Freedom of Scottsdale, was concerned with the case.
The groups dispute, that the abortion law targets specifically Asian and black women, while on the other hand, sponsors view that, they may choose abortion because of sex and race of child. Arizona is the only city that ban race based abortion, although other cities forbid on the issue of the baby’s sex.
Three judge’s panel decision reveal that, “Plaintiffs purport to present an alternate basis for standing resulting from being the targets of. . . discriminatory intent, That theory is a mere repetition of Plaintiffs’ stigmatic injury, which does not support standing.”
Executive director of the National Asian Pacific American Women’s Forum, Miriam Yeung said that, she was “deeply disappointed” by the decision of the panel.
“We’d like to remind folks that this was not a hearing about the original merits of the case, which we stand by, that so-called prenatal non-discrimination laws are discriminatory, Our lawyers at the ACLU are going to figure out, what our next steps are,”she added.
According to Republican Arizona lawmakers, they are concerned about the abortion of female babies. The number of girl child abortion would be in the rise as, the Asian immigration increase to the state, because some Asian cultures value only male child.
Alliance senior counsel Steven Aden said in a statement that, “Preserving the life of all babies, regardless of their sex or race, should be everyone’s priority. Sadly, it wasn’t for the American Civil Liberties Union (ACLU) and the NAACP. The 9th Circuit rightly upheld the district court’s decision to dismiss their lawsuit. Nothing about an abortion is committed on the basis of sex or race, is medically necessary or constitutionally protected.”
