A Court ruling overturned a Federal Aviation Administration order from 2014 that set new paths for phoenix’s Sky Harbor International Airport.
A three judge panel of the U.S Court of Appeals for the district of Columbia circuit earlier in the day agreed that the FAA decision in 2014 to change the routes in and out of Sky Harbor International Airport in phoenix was “arbitrary and capricious”.
The FAA under Next Gen Program has made similar changes in flight paths of other airports around the country.
The agency has implemented the new flight paths in September 2014 as a part an attempt to streamline aircraft routing for safety and efficiency of flights ta and from phoenix Sky Harbor International Airport.
This Airport has around 1200 air crafts and more than 120,000 passengers arrive and depart each day.
Phoenix city residents and the city complained FAA did not consult before hand with senior city officials, elected officials or residents of the affected communities.
“By keeping public in dark, the agency made it hard for the public to submit views on the project’s potential effects, views that FAA is required to consider” The court ruled.
Next move of the agency is still not known, but they released a statement saying “We will carefully review the decision before deciding on our steps”.
This news spread joy in the neighborhood residents and city officials, Phoenix Historic Community association said that thousands of residents were affected by this rerouting that they filed their individual legal challenge in addition the one city filed.
One of the residents said that, “We are thrilled that the court saw the errors that FAA made, and agrees that the process was faulty and needs to be done right”.
He also said, “Overnight we woke up to aircraft flying over our neighborhood all the time”, “we never had that before. Since then, thousands and thousands of planes flown over our house”.
The residents said that this effected there everyday life style, people shut themselves in their AC rooms when the temperature is high, they could no longer go outdoors when the weather is beautiful and could even open their windows at night.
The one time air line pilot and former FAA inspector said that he expected the agency would fight the decision.
Phoenix Mayor Greg Stanton said, it was just wrong of FAA to take a step that negatively impacted the lives of thousands of phoenix residents without seeking meaningful input from our community or the city, today’s decision affirms that the FAA needs to go back to the drawing board and work right.
After the FAA has implemented the new flights path three years ago, over the following two weeks the air port has received more noise complaints than it had in all of the previous years.
