Lawsuit Trials USICS power to modify policies on H1B workers Placement

A lawsuit has been filed against, the United States Customs and Immigration Services USCIS, in the district court of the United States, in Newark, New jersey, challenging the recent changes made ny agency in terms of policies and regulations that claims , all the possible attempts made to make US companies stop sponsoring H1B workers.

The Law suit was filed on May 1, stating that the USCIS has o0vercome its authority by imposing such severe restrictions on assigning H1B workers to the third party work sites, which would impact employees as well as the employers in the country.

AS a representation of Plaintiff, Thomas Vinu Allen, the attorney dealing the case, said that only congress has the power to pass such resolutions and regulations including the actions that to be taken by USCIS, through its policy memorandums which are arbitrary and capricious.

The members of the plaintiffs include Edison, Small and Medium Enterprise Consortium based in New Jersey, a non profit trade association which is focused on the welfare and betterment of IT staffing and consulting companies along with two other IT service providers, the litigators claim that they were unable to find sufficient qualified IT employees in the United States.

The lawsuit consisting of 40 pages, seeks a transient hold back order and preliminary injunction enjoining USCIS from enforcing new illegal requirements, defining employer, itineraries and also mentioning about the Specific and non Speculative assignments.

The Attorney also said that, there are thousands of H1B petitions, that have been denied and many other foreign workers have been forced to leave their native countries, since majority of IT professionals claim to be from India, these denials have severely impacted on the IT community.
